Initial Membership Term, Renewal & Age Category Pricing
Initial Membership Term
All memberships at Major Athletics & Performance Inc. are subject to an initial one (1) year commitment, commencing on the Membership Activation Date. The initial one-year term is designed to support long-term athlete development, rehabilitation, performance progression, and ongoing reassessment. Members agree to maintain their membership and fulfill all payment obligations for the duration of the initial term, except where otherwise permitted under this Agreement or as required by applicable law. During the initial one-year term, members will receive individualized programming, ongoing monitoring, scheduled reassessments, and professional recommendations based on their progress and goals.
Membership Renewal
Upon completion of the initial one-year membership term, the membership will automatically renew on a month-to-month basis and will continue uninterrupted unless cancelled by either the member or Major Athletics & Performance Inc. in accordance with this Agreement. Following the initial one-year term:
- Membership will continue on a month-to-month basis.
- Members may cancel their membership by providing thirty (30) days' written notice.
- Monthly membership fees will continue to be charged using the authorized payment method until the membership is properly cancelled.
- Major Athletics & Performance Inc. may conduct periodic reassessments and reserves the right to recommend changes to the member's services or membership level based on performance, rehabilitation progress, clinical findings, goals, age, or other relevant factors.
- Major Athletics & Performance Inc. reserves the right to amend membership fees from time to time. Any pricing changes applicable to month-to-month memberships will be communicated in advance in accordance with applicable law.
Age Category Pricing
Membership pricing is determined by the athlete's age on the Membership Activation Date. If an athlete advances into a new age category during the initial one-year membership term, the athlete will continue to pay the membership rate applicable at the time of enrolment for the remainder of the initial one-year commitment. Upon completion of the initial one-year membership term, when the membership automatically converts to a month-to-month membership, the athlete will automatically transition to the appropriate membership category based on their age at that time and will be charged the then-current membership rate for that category.
Example
An athlete joins Major Athletics at 11 years of age under the 5–11 Athlete Membership. If the athlete turns 12 years old during the initial one-year membership term, the athlete will continue paying the 5–11 membership rate until the completion of the initial one-year commitment. When the membership renews on a month-to-month basis after the initial one-year term, the athlete will automatically transition to the 12–18 Athlete Membership and the applicable month-to-month membership rate.
Right to Review and Renew
Renewal of membership is contingent upon the member:
- Remaining eligible under the Membership Eligibility Policy.
- Maintaining the account in good financial standing.
- Complying with all facility policies, procedures, and the Member Code of Conduct.
- Maintaining current medical and emergency contact information where applicable.
Major Athletics & Performance Inc. reserves the right to refuse renewal, suspend, or terminate any membership in accordance with this Agreement where continued participation is determined to be unsafe, inappropriate, or inconsistent with the policies, standards, or values of the facility.
Membership Upgrades
Purpose
Major Athletics & Performance Inc. offers a range of membership programs designed to meet the evolving needs of athletes throughout their development, rehabilitation, and performance journey. Members may become eligible for upgraded services as their goals, training requirements, or clinical needs change.
Practitioner Recommendation
Membership upgrades are based on professional assessment and recommendation. A member may be recommended for an upgraded membership due to:
- Increased training or performance needs.
- Injury or rehabilitation requirements.
- Return-to-play programming.
- Changes in competitive level.
- Age category progression (following the initial one-year membership term).
- Clinical recommendations made by Major Athletics practitioners.
While members may request an upgrade, all upgrades are subject to review and approval by Major Athletics & Performance Inc.
Effective Date of Upgrade
Approved membership upgrades will become effective on the next scheduled billing date unless otherwise determined by Major Athletics. Where additional services are required immediately for clinical or rehabilitation purposes, Major Athletics may activate the upgraded membership immediately and apply a prorated charge for the remainder of the current billing cycle.
Membership Term Following an Upgrade
An approved membership upgrade does not restart or extend the initial one-year membership commitment. The original Membership Activation Date remains in effect, and the initial one-year term continues uninterrupted unless otherwise agreed to in writing.
Pricing
Upon activation of an approved upgrade, the member will be responsible for the membership fee applicable to the upgraded membership. Any prorated charges or billing adjustments will be clearly communicated before the upgraded membership becomes effective.
Temporary Upgrades
Where clinically appropriate, Major Athletics may recommend a temporary upgrade to a higher level of service for a defined period, such as:
- Injury rehabilitation.
- Return-to-play programming.
- Increased competition demands.
- Seasonal performance preparation.
At the conclusion of the recommended period, the member may return to their previous membership level or transition to another recommended membership based on reassessment.
Right to Decline an Upgrade
Major Athletics reserves the right to decline a requested membership upgrade where:
- The requested services are not clinically appropriate.
- Participation may create a health or safety concern.
- Required documentation has not been completed.
- The requested membership has reached capacity.
- The member is not in good financial standing.
Members may upgrade at any time, but downgrades are only permitted at the end of the initial one-year membership term or where recommended by a Major Athletics practitioner for clinical reasons.

Purpose
Major Athletics & Performance Inc. reserves the right to temporarily suspend a membership where necessary to protect the safety of members, staff, contractors, visitors, or the integrity and operations of the facility. Payment Policy
1 Purpose
This Payment Policy establishes the financial obligations of all members of Major Athletics & Performance Inc. and outlines the procedures governing recurring billing, payment processing, overdue accounts, administrative fees, account suspensions, and collection procedures. By entering into this Membership Agreement, the member and/or parent or legal guardian acknowledges and agrees to comply with this Payment Policy.
2 Monthly Recurring Billing
All memberships are billed through recurring monthly payments beginning on the Membership Activation Date. Membership fees will automatically be processed on the designated monthly billing date using the payment method authorized by the member. Membership fees remain payable regardless of attendance or use of the facility unless the membership has been cancelled in accordance with this Agreement. The member is responsible for ensuring sufficient funds are available on each billing date.

- Outstanding balances
- Any other authorized charges related to the member's account
Members are responsible for notifying Major Athletics immediately of any changes to:

Failure to maintain valid payment information does not relieve the member of their payment obligations.
4 Accepted Payment Methods
Major Athletics currently accepts approved electronic payment methods designated by the facility. Accepted payment methods may include:
- Credit cards
- Debit payments (where available)
- Pre-authorized bank withdrawals (if offered)
Major Athletics reserves the right to modify accepted payment methods at any time. Recurring memberships will not be accepted through cash payments unless specifically approved by Major Athletics.
5 NSF & Declined Payment Fees
If a payment is declined, returned, reversed, or otherwise unsuccessful, the member remains responsible for the outstanding balance. Major Athletics may charge a reasonable administrative fee, as established by the facility from time to time and permitted by applicable law, for each:
- Declined payment
- Returned payment
- Non-sufficient funds (NSF) transaction
- Rejected pre-authorized debit
- Failed recurring payment
- Unjustified chargeback
This administrative fee is intended to offset the costs incurred by Major Athletics in processing failed transactions and managing the account. Major Athletics reserves the right to retry the payment using the authorized payment method. Repeated failed payments may result in suspension or termination of membership.
6 Delinquent Payment Procedure
Where payment has not been successfully received, Major Athletics will generally follow the process below. These timelines may be modified where appropriate.

- Scheduled payment processed.
If payment is unsuccessful: Day 1

To the extent permitted by applicable law, the member may be responsible for reasonable costs associated with recovering outstanding amounts. Referral to collections may affect the member's ability to obtain future services from Major Athletics.
8 Interest on Overdue Accounts
Where permitted by applicable law and as disclosed in this Agreement, overdue balances may accrue interest beginning after a specified grace period. The applicable interest rate will be the rate stated in this Agreement or the maximum rate permitted by law, whichever is lower. Interest will continue to accrue until the outstanding balance has been paid in full. (Before inserting a specific rate, have it reviewed by your legal counsel to ensure compliance with Ontario law.)

- Performance training
- Sports medicine appointments
- Rehabilitation services
- Assessments
- Return-to-play programming
- Camps

- Future appointment bookings
Suspension of services does not relieve the member of their obligation to pay outstanding amounts. Membership fees may continue during a suspension where the membership remains active and the member's place in the program is being reserved, unless otherwise agreed to in writing.
10 Billing Disputes
Members who believe a billing error has occurred must notify Major Athletics in writing within thirty (30) days of the transaction. Major Athletics will investigate the matter and correct any verified billing errors.

- Recover any associated costs.
- Suspend membership.
- Require an alternative payment method for future transactions.
- Terminate the membership where appropriate.

2.13 Delinquent Payment Policy
Purpose
The purpose of this Delinquent Payment Policy is to establish a fair, transparent, and consistent process for managing overdue membership accounts while providing members with reasonable opportunities to resolve outstanding balances before further action is taken. Major Athletics & Performance Inc. recognizes that payment issues may occasionally occur; however, members are responsible for maintaining their accounts in good financial standing throughout the duration of their membership. Failure to make timely payments may result in suspension of services, cancellation of appointments, termination of membership, and collection activity. Day 1 – Payment Failure If a scheduled membership payment cannot be successfully processed on the scheduled billing date, the member's account will automatically be identified as having a failed payment. A failed payment may occur due to, but is not limited to:
- Insufficient funds.

Major Athletics reserves the right to charge any applicable administrative fee associated with failed payment processing. Courtesy reminders may be delivered by:
- Email.

The reminder will generally include:
- Outstanding balance.
- Original payment date.
- Reason for payment failure, if known.
- Instructions for updating payment information.
- Payment options.
- Timeline before additional action may occur.
The courtesy reminder is intended to assist members in resolving payment issues promptly and should not be interpreted as a waiver of any rights available to Major Athletics under this Agreement. Day 7 – Second Payment Attempt If payment remains outstanding seven (7) days after the original billing date, Major Athletics may initiate a second attempt to process the authorized payment method. Where payment continues to be unsuccessful:
- The account will be designated as overdue.
- Staff may contact the member directly.
- Future appointments may be reviewed.
- New appointments may be restricted until payment arrangements have been made.
- The member may be required to provide updated payment information.
Members who anticipate payment difficulties are encouraged to contact Major Athletics before this stage to discuss available options. Major Athletics may, at its sole discretion, enter into temporary payment arrangements where appropriate. Day 14 – Membership Suspension If payment has not been received within fourteen (14) days of the original billing date, Major Athletics may suspend the member's account. During suspension:

- Future appointments may be cancelled or postponed.
- Training sessions may not be attended.
- Therapy appointments may be postponed where clinically appropriate.
- Assessments may not be scheduled.
- Online member access may be restricted.
- Priority booking privileges may be removed.
Suspension does not terminate the Membership Agreement. Suspension does not eliminate the member's responsibility to pay all outstanding amounts. Unless otherwise approved by Major Athletics, membership fees may continue to accrue during the suspension period. Membership may be reinstated once:
- All outstanding balances have been paid.
- Payment information has been updated.
- Any applicable administrative fees have been paid.

Referral to a collection agency may affect the member's credit history where permitted under applicable law. Major Athletics may also recover reasonable administrative, legal, and collection costs where permitted by law.
Payment Resolution
Members may avoid further collection activity by contacting Major Athletics before legal or collection action has commenced. Major Athletics may, at its sole discretion, consider:
- Payment plans.
- Temporary payment arrangements.
- Short-term extensions.
- Alternative payment methods.
Approval of any payment arrangement is entirely at the discretion of Major Athletics and must be confirmed in writing. Failure to comply with an approved payment arrangement may result in immediate progression to collection activity.
Right of Major Athletics
Major Athletics & Performance Inc. reserves the right to accelerate or modify the timelines outlined in this policy where:
- Fraudulent activity is suspected.
- Chargebacks have been initiated without justification.
- False payment information has been provided.

Medical documentation may be requested before any exception is considered. At the sole discretion of Major Athletics, approved medical exceptions may include:
- Temporary Membership Hold
- Maintenance Membership
- Modification of services
- Alternative programming
- Cancellation without further financial obligation where appropriate
Approval is not automatic and will be evaluated on an individual basis.
Relocation Policy
Members who permanently relocate a substantial distance from a Major Athletics facility may request early cancellation of their membership. Members requesting cancellation due to relocation may be required to provide documentation confirming their permanent move, such as:
- Employment documentation
- Educational enrollment
- Residential lease or purchase agreement
- Government-issued identification reflecting the new address
- Other documentation acceptable to Major Athletics
Each request will be reviewed individually. Temporary travel or seasonal residence does not normally qualify for cancellation under this policy. Where appropriate, Major Athletics may instead recommend a Membership Hold or Maintenance Membership.
Refund Policy
Membership fees are generally non-refundable. Refunds will not be issued for:
- Missed appointments
- Failure to attend scheduled sessions
- Vacation
- Illness of short duration
- Lack of participation
- Scheduling conflicts
- Change of sport
- Voluntary withdrawal
Refunds may only be considered where:
- Required by applicable law.
- Approved in writing by Major Athletics.
- A billing error has occurred.
- Services cannot reasonably be provided due to circumstances beyond the member's control and Major Athletics determines that a refund is appropriate.
Any approved refund will be processed using the original payment method whenever reasonably possible.
Missed Appointments
Appointments are reserved exclusively for each member. If a member cannot attend a scheduled appointment, advance notice is required. Repeated missed appointments negatively affect other members by reducing appointment availability. Members are expected to make every reasonable effort to attend all scheduled appointments or provide appropriate notice when attendance is not possible. Major Athletics reserves the right to monitor attendance patterns and may review continued membership where excessive missed appointments occur. No-show fee will apply based on the Major Athletics and Performance rate.
Late Appointment Cancellations
Members who cancel an appointment with less than twenty-four (24) hours' notice may be subject to a Late Cancellation Fee, as established in the current Facility Fee Schedule. Late cancellations may also result in:
- Loss of the scheduled appointment.
- Forfeiture of the session.
- Reduced booking priority where repeated late cancellations occur.
- Review of continued membership eligibility if excessive cancellations become a pattern.
Major Athletics reserves the right to waive Late Cancellation Fees in exceptional circumstances, including emergencies or other situations considered reasonable by the facility.
No-Show Policy
A "No-Show" occurs when a member fails to attend a scheduled appointment without providing the required notice. No-Shows significantly impact scheduling, practitioner availability, and access to services for other members. Where a No-Show occurs, Major Athletics may:
- Charge the applicable No-Show Fee outlined in the Facility Fee Schedule.
- Deduct the appointment from the member's available services, where applicable.
- Restrict advance booking privileges.
- Require future appointments to be confirmed.
- Require prepayment for future appointments.
- Suspend online booking privileges.
- Review the member's account for continued participation if repeated No-Shows occur.
Repeated No-Shows may be considered a breach of the Membership Agreement and may result in suspension or termination of membership.
Exceptional Circumstances
Major Athletics understands that genuine emergencies occasionally occur. Examples may include:
- Medical emergencies
- Family emergencies
- Severe weather
- Motor vehicle accidents
- Other unforeseen circumstances
Major Athletics reserves the right to waive cancellation fees, No-Show fees, or other penalties where, in its sole discretion, the circumstances warrant such consideration.
